CHAUFFEUR DRIVEN CARS
Eligibility
Should be of minimum 18 years and above. - Children below the age of 18 can't travel alone and must be accompanied by an adult at all times.
Booking Process:
- Booking will be made on the App based on Journey as well as the type of car preferred.
- All Tolls, Taxes and Parking Fees are borne by the customer. All distance and time are calculated from Garage to Garage. Any damages to the vehicle either temporary or permanent, done by the customer will be fully reimbursed by the customer to the extent that the vehicle is fully back up into operation.
- Airport transfers are not part of the outstation/local trips. Please verify with us if you are planning Airport pickup/Drop off service.
Customer Responsibilities:
- Our chauffeurs will drive cars as per the legal RTO regulations put forth in each city with respect to speed, routes and style of driving.
- Influencing the chauffeur to drive rashly, at high speed or abusing our chauffeurs in any way is strictly prohibited. All complaints must be directed to Hype at any point in time before, during or after the journey.
- Adding more passengers than the legal limit is strictly not allowed and the vehicle will simply return to the garage in such cases without any refund.
- Our chauffeurs will have full authority to deny boarding to customers in case of any alcohol, food and drink or any other potential hazards to the safety and features of the vehicle or journey. He may simply return to our office without informing us in such cases.
- Carrying illegal Firearms, ammunition, drugs or any other illegal activities is prohibited and the journey shall be discontinued and the vehicle returned the moment it is found out.
- Customers will be responsible for any damage that may occur to the car or chauffeur if they influence the chauffeur to drive/do things that are not in the purview of the agreed plan/trip/contract.
- In Chauffeur driven cars, maximum driving duration is for 12Hrs and 300 Kms only (whichever occurs first). We reserve the right to stop the journey as it is not good for either the chauffeur nor the car for prolonged journeys.
- Our chauffeurs must be treated with respect, dignity and humility. Abusing them in any manner might lead to legal action against the customer.

Replacement of Vehicle:
- Replacement Vehicle shall be provided within city limits only (subject to availability of similar segments in the city). This is only for such cases where a vehicle develops mechanical error and restrains the user from its use. In a case where a vehicle develops such an error outside the city limit, a replacement vehicle will not be provided and amount equivalent to the agreed rental will be charged. Company decisions related to replacement vehicles will be final.
Indemnity:
- The User hereby releases and agrees to indemnify Hype from and against any liability for loss or for damage to any property (including costs relating thereto) left, stored or transported by the User or any other person in or upon the vehicle before or after return of the vehicle.
- The User shall be solely responsible for and shall keep Hype fully indemnified against any loss, theft, damage, costs, accident or injury (including death) to persons or property, including loss, theft, damage, accident of the vehicle, accruing in connection with the vehicle or as a result of the negligent use thereof and against any breach of obligation by the user of the vehicle.
- The User shall keep Hype fully indemnified including its directors, employees and shareholders against all losses, liabilities, costs, actions, claims, any fines or penalties imposed (Losses) in respect of these Terms and Conditions or arising out of or in connection with use of the vehicle including Losses on account of any third party liability, damage to the vehicle, accidents, illegal use of the vehicle, misrepresentation or breach of its obligations by the user.
- The User hereby acknowledges that for the purposes of the Motor Vehicles Act, 1988, the User shall be liable in respect of the vehicle for any of the offences which may be committed under the applicable law and for any liability with respect to the use of the vehicle including but not limited to any challans, penalties, third party liability, accidents and the User shall indemnify against any losses, damages, costs and liabilities etc., in this regard.
Disclaimer:
- The User acknowledges that the use of the Services is at his sole risk. Hype disclaims all representations and warranties of any kind, whether express or implied, as to condition, suitability, quality, merchantability and fitness of the services offered by it.
- Hype shall not be responsible or liable for any loss or damage, however caused or suffered by the User arising out of the use of the services or due to Hype's failure to provide the services at all, for any reason whatsoever whether or not beyond the control of Hype.
SELF DRIVE
Eligibility
- Minimum age to drive our cars is 30 years.
- Should have at least 7 years of having a valid driver's license.
Booking Process
- We request you to send your Driver License and Aadhaar copies by email to us before the date of journey and at the time of booking. The customer is expected to provide copies of Aadhar card and a valid driving licence in order to book the vehicle, in case of Indian Nationals. In case of Foreign Nationals, they should provide an International driving permit, residence proof of stay in India, and a copy of Passport. The customer in whose name the booking has been made is solely responsible for allowing anyone else other than him/her to use the vehicle. Hype considers it to be a breach of contract and will not be responsible for any claims made by the customer.
- We don't allow car pick-ups and drop-offs from our garages for security reasons. Our Operations crew will handle delivery and pickup, and this service is chargeable and will be deducted from the deposit amount.
- Prices are calculated based on the destination discussed at the time of booking. Any changes need to be shared with us in advance, and may impact the prices and other RTO regulations.
- Per day, 150 Kms is allowed and additional kilometers are charged at an extra cost.
- A security deposit will be charged for self-drive car rentals. The deposit amount varies based on the car model. Refunds may take 15–30 working days after the provisional refund statement is prepared. However, this period may be extended in cases of bulk bookings or interstate rentals. The refund will be initiated only after a complete evaluation of the car and verification through GPS tracking. In case of any damages, the refund process may take additional time. If the car is overspeeding, damaged, or involved in any kind of dispute or negotiation, the refund timeline may be further extended, as the company will need to obtain necessary clearances from relevant authorities and operations teams.
Customer Responsibilities
- It is the customer's responsibility to inspect the vehicle and report/record damages at the time of taking the delivery of the car. Any complaints later on will not be entertained.
- All cars are insured bumper to bumper for the safety of the individual, third party, and the vehicle. The insured amount varies from vehicle to vehicle, but it is usually high.
- Any damages, internal or external, will be first recovered from the customer's safety deposit. If the damage cost exceeds the deposit, the customer will have to pay the additional amount. The decision to apply for insurance in such matters lies with the provider, and Hype cannot interfere in that matter. You as a customer agree to this condition.
- Maximum speed legally allowed is 100 Kms/Hr and over speeding may result in a penalty of Rs. 1500 per offense.
- No alcohol, drinking, or smoking is allowed inside our luxury fleet. If the vehicle is not returned in a clean condition, cleaning charges will be applicable.
- All local taxes, tolls, parking tickets, and traffic violations are to be paid by the customer. Any serious traffic violations may attract an additional fine for jeopardizing public safety.
- Fuel is to be borne by the customer. All rides are Full Tank to Full Tank. Fuel at actuals will be charged if the tank is not full upon return.
- Any damage-related expenses will be completely borne by the customer at the time of return. These will be either deducted from the deposit or billed separately if the amount exceeds the deposit.
- Causing damages will attract additional charges for downtime, as the vehicle may become unusable for other customers and cause loss of revenue to the company.
- We require the complete address where the car will be parked. Street-side parking is not allowed and will be detected by our GPS system and may attract penalties.
- Cars cannot be abandoned on the road or anywhere without duly informing Hype and taking approval. This may result in the security deposit being impounded and further legal action for negligent behavior.
- Failing to return the car as per the agreed schedule may result in a runtime penalty, which may completely deduct the entire safety deposit amount for causing loss of booking and hindrance in administrative work.
- The company does not allow the vehicle to be used to carry pets, goods, or any other object which can damage the upholstery or any part of the vehicle. In such an event, the user will be charged for the actual cost of repairing or cleaning the vehicle.
- Carrying illegal firearms, ammunition, drugs, or engaging in any other illegal activities is strictly prohibited. The car cannot be used for towing, teaching driving, racing, speed testing, leasing out to others, or for commercial purposes.
- You should not carry more passengers than the number of seat belts in the vehicle or more than what is authorized in the vehicle’s registration documents.
- In case of wrong fueling (e.g., petrol in a diesel car or vice versa), the customer will bear the cost of all damages, including a minimum of two days’ rental charges as demurrage. This is not covered by insurance.
Tyre Damage Coverage
- The cost of repair or replacement for any tyre damage incurred during the rental period will be completely recovered from the deposit. This includes damage such as punctures, cuts, sidewall abrasions, bulges, or any issues caused by misuse, negligence, or driving conditions.
Assessment and Charges
- Upon return of the vehicle, our team will conduct a thorough inspection of the tyres. If any damage is identified, the customer will be informed immediately, and a detailed assessment, including photographs, will be shared.
- The charges will be calculated based on the current market rate for repairs or replacement, as applicable.
Customer Responsibility
- We encourage our customers to inspect the vehicle, including tyres, before starting their journey to ensure any pre-existing issues are documented.
- Customers are advised to avoid driving on uneven terrain, at high speeds, or under conditions that may put unnecessary stress on the tyres.
- By adhering to this policy, we aim to maintain the safety and quality of our vehicles while providing a fair and consistent approach to handling tyre damages. Should you have any questions or require further clarification, please contact our support team.
Replacement of Vehicle
- A replacement vehicle shall be provided within city limits only, subject to availability of similar vehicle segments. This is applicable only when the original vehicle develops a mechanical error that prevents its use. If the breakdown occurs outside city limits, a replacement will not be provided, and the full rental amount will still be charged. All decisions related to replacement vehicles will be final and at the discretion of the company.
Indemnity
- The user hereby releases and agrees to indemnify Hype from and against any liability for loss or damage to any property (including related costs) left, stored, or transported in or upon the vehicle before or after its return.
- The user shall be solely responsible and shall keep Hype fully indemnified against any loss, theft, damage, costs, accidents, or injuries (including death) to persons or property in connection with the vehicle or due to its negligent use, and against any breach of obligations by the user.
- The user shall indemnify Hype, including its directors, employees, and shareholders, against all losses, liabilities, costs, actions, claims, fines, or penalties arising from or in connection with the use of the vehicle. This includes third-party liabilities, damage to the vehicle, accidents, illegal use, misrepresentation, or breach of obligations.
- The user acknowledges that under the Motor Vehicles Act, 1988, they shall be liable for any offenses committed with the vehicle and for any resulting penalties, challans, accidents, or third-party liabilities. The user shall indemnify Hype for any losses or damages arising in this regard.
Disclaimer
- The user acknowledges that the use of the services is at their own risk. Hype disclaims all warranties, express or implied, regarding the condition, suitability, quality, merchantability, and fitness of the services offered.
- Hype shall not be responsible for any loss or damage suffered by the user due to the use of the services or due to any failure by Hype to provide the services, whether or not it was within Hype’s control.
GENERAL TERMS AND CONDITIONS
Eligibility
- Should be of minimum 18 years and above. - Children below the age of 18 can't travel alone and must be accompanied by an adult at all times.
- For Self Driven cars, refer the self drive terms and conditions.
Booking Process:
- Cars are issued to the person who contacts and sends details to Hype. If at any point in time we find that the car is being driven by a different person or used for a different purpose, we may cancel the trip abruptly and recall the car without any refunds.
- We reserve the right to refuse bookings or on-boarding of customer without any explanation as per our safety and security standards even if the booking has been received
- Customer name used in the Booking invoice will finally be responsible for all T&C mentioned here in order to return the car in the condition given.
- Since Hype is an online company there may be times when our technical team may be conducting online tests. During such times the values/ prices/ details of the fleet may be completely different from the actual ones, in such cases if there is any booking made by the customer on such fleet will be cancelled immediately with complete refund
Cancellations
- Any cancellation/modification to be informed only via email between 10am to 7pm on all working days and minimum 4 hours prior to the scheduled time
- Any cancellation under 24hrs of the scheduled time will attract 100% charges Standard cancellation charges until last 24hrs of scheduled time will be 50%
- Payment Gateway charges are not refunded on any platforms for any type of booking cancellations
- When the customers intended program/event gets cancelled by the respective event organization/individuals, Hype will not be considering them as reasons to consider any special cancellation policy applicable for that booking. In such cases refund may take upto 6 months after the finalization of the refund amount.
- When bulk bookings are made well in advance for any public/private events where Hype and/or its vendors are also providing fleets to that program either jointly or independently, the cancellation charges will be higher upto 100% cancellation fee. In such cases refund may take upto 6 months after the finalization of the refund amount.
Customer Responsibilities
- All of our chauffeurs are COVID19 vaccinated and have been trained on professional etiquettes and standards of customer interaction.
- All cars are subject to availability and in as is condition.
- We usually have a good mix of latest and previous generation cars in the fleet. We strive to send you the latest editions based on availability but can't guarantee new or latest models always. If you have specific requirements for certain models, please call us and specify the requirement so that we can explore the serviceability.
- Safety of our vehicle, chauffeur and passenger is utmost important to us. In case if we feel the contractual terms or safety standards are compromised for whatever reason, we may recall the car and chauffeur unconditionally. Refunds are subject to further evaluation of the situation.
- In case of any communal riots, natural disaster or any other threats that our chauffeurs encounter during the trip, we may call back the car without prior notice to the customer
- In case if the car is used for any illegal activities, the customer will be completely responsible for the entire issue including the compensation to us.
- Any damages caused or violation of traffic rules may result in profuse delay in refunds.
Replacement of Vehicle

Geo-Fencing Technology
- Company utilizes geo-fencing technology as part of its mobility services. Geo-fencing involves the use of virtual boundaries or geographic areas to enhance the functionality and safety of our services.
Location Data Collection
- By using our mobility services, you acknowledge and consent to the collection and processing of location data associated with your device. This data is collected to facilitate service provision, optimize routes, improve safety measures, and enhance overall user experience.
Geo-Fenced Zones
- We may establish specific geo-fenced zones to regulate the operation of our services, including designated pick-up and drop-off areas, restricted zones, or other relevant areas for service management purposes.
Compliance with Geo-Fencing Restrictions
- As a user of our mobility services, you agree to comply with all geo-fencing restrictions and guidelines set by Company. This includes adhering to designated pick-up and drop-off locations, avoiding restricted areas, and following any specific instructions provided through our application or communication channels.
Notifications and Alerts
- Our application may provide notifications and alerts to inform you about geo-fencing restrictions, updates, or changes to the designated zones. It is your responsibility to review and acknowledge these notifications to ensure compliance.
Safety and Security
- Geo-fencing technology is employed to enhance the safety and security of our services. However, it is important to note that the accuracy and reliability of location data may vary based on external factors such as GPS signal strength and device capabilities. While we strive for accuracy, we cannot guarantee uninterrupted or error-free service in all circumstances.
Prohibited Actions
- You agree not to tamper with, manipulate, disable, or circumvent the geo-fencing technology implemented by the Company. Any attempts to do so may result in the termination of your access to our services and may also be subject to legal action.
Limitation of Liability
- Company shall not be held liable for any damages, losses, or injuries arising from the use of geo-fencing technology, including inaccuracies in location data, reliance on notifications or alerts, or non-compliance with geo-fencing restrictions.
Modification of Geo-Fencing Clause
- Company reserves the right to modify or update this geo-fencing clause in the Terms and Conditions at any time. Any changes will be communicated through appropriate channels, and your continued use of our services following such changes constitutes acceptance of the modified terms.
Geo-fencing and Limitation of Services Availability
- Company provides the mobility services only in the location mentioned on our platform but can't claim that it will always be able to provide service in those locations. Company is also not responsible or obligated to provide any services other than the mentioned locations globally. Company may or may not show its interest to provide service in any areas of its operation or to support or to encourage or find out similar services where it is not operating. This is applicable uniformly to all the customers that are current, past or future. In case if the customers drive or fly or sail to the locations that are not prescribed in the contract without notifying the company and taking explicit permission, they will be responsible fully for their actions and consequences.
Pricing Disclaimer
- At Hype Luxury, we strive to maintain accurate and transparent pricing. However, due to internal system upgrades or testing, occasional errors may occur. In such cases, all bookings will be carefully reviewed, and Hype reserves the right to cancel any reservation where the online price is not aligned with our business model. We appreciate your understanding and remain committed to delivering exceptional service.

6. General customer behavior while using transport airplane service through transport airline provider
Customers/passengers are expected to behave reasonably while utilizing TAO services, refraining from actions causing discomfort, inconvenience, damage, or injury to the crew. Measures may be taken, including disembarkation, to prevent continuation of such conduct. Customers are encouraged to take full responsibility for their items, as TAO is not liable for lost or damaged items.
All calls made to Customer Care are recorded for quality and training purposes. Customers/passengers must adhere to reasonable conduct standards, with HYPE LUXURY/TAO reserving the right to deny boarding to those displaying unsafe behavior or under the influence of alcohol.
In situations endangering the aircraft, passengers, or property, or obstructing crew duties, TAO reserves the right to take necessary measures, including restraint, and may prosecute for offenses committed on board.
7. Reviews, comments, and communications
Visitors may post content on the Website, provided it complies with guidelines. We reserve the right to remove/edit content but do not regularly review posted content.

In the event of the cancellation of the original flight, all bookings for promotional and ferry flights will be automatically cancelled.
10. Pricing and Payment schedule
Flight quotes provided by HYPE LUXURY ("Flight Quotes") are subject to aircraft and crew availability, as well as owner approval. These quotes are based on information supplied by the Operator, and while every effort is made to ensure accuracy, HYPE LUXURY does not guarantee it. Customers acknowledge that Flight Quotes can change before receiving a booking confirmation, and HYPE LUXURY is not liable for such changes.
Flight Quotes may not cover certain additional fees such as special catering, ground transportation, flight phone usage, flight internet (Wi-Fi) usage, aircraft damage, pet-related fees, or cleaning/maintenance fees due to excessive use. Any significant changes requested by the customer may result in additional costs, which the customer is responsible for.
Watch hour extension charges may apply and will be specified either at booking or at a later time if additional services are added. Unless otherwise instructed, charges for additional expenses are payable pre-flight.
For services booked through www.gohype.in / www.hype.luxury, payment is charged to the customer's credit/debit card/bank transfer before confirmation. If HYPE LUXURY cannot provide the service for any reason, the customer will be notified electronically, and the payment will be refunded.
Please note that prices on the website are quoted in Dollar/INR currency. The actual amount charged to the customer's credit card will be in their card's currency at the time of billing.
Any special requests regarding booking or travel itinerary will require a customized quote, which may include special permission charges and airport taxes.
All payments to TAO are exclusive of statutory taxes. If taxes change after booking, the customer is responsible for the difference. Corporate customers or individuals subject to income tax audit must deduct TDS at 2% and provide the necessary documentation.
Payment Schedule:
An initial flight reserve amount of INR 100,000 must be paid immediately to reserve a flight.
The balance payment for a booking must be made within 24 hours via NEFT/RTGS or another preferred mode of payment specified by HYPE LUXURY. Failure to do so will result in cancellation, with applicable charges deducted from the reserve amount.
Final Invoice:
HYPE LUXURY will send a final invoice detailing all incurred charges after the flight or upon receipt of additional service charges from the Operator. Any outstanding amounts are subject to interest if not paid within five (5) days.
If a payment is rejected, the customer is responsible for reimbursing HYPE LUXURY for any associated fees.
11. Terms of Cancellation
Cancellation or modification of flights is subject to HYPE LUXURY's airline cancellation policy or the terms outlined below. Customers must familiarize themselves with the refund policy outlined below prior to booking.
Cancellation charges can range up to 100% of the booking cost, depending on the timing:
- 20 Days - 48 Hours: 50% of total price
- 48 Hours - 24 Hours: 80% of total price
- Less than 24 Hours: 100%; no refund
Cancellation of a flight by HYPE LUXURY due to reasons such as weather, technical issues, or regulatory restrictions may entitle the customer to alternative arrangements, subject to availability.
In case of cancellation or rescheduling of a flight, HYPE LUXURY is not liable for any resulting loss or damage.
Aircraft owner approval is required for each booking. If approval is not granted, HYPE LUXURY will attempt to adjust the terms or find a replacement aircraft, with potential surcharges applicable.
Empty Leg Cancellation:
Empty Legs may be cancelled at any time without notice due to various reasons, with no obligation for HYPE LUXURY to provide a replacement aircraft. Customers are only liable for the price paid for the cancelled Empty Leg.
Empty Leg Flights:
Discount offers on Empty Leg Flights are subject to specified terms and conditions and may be modified or withdrawn without notice.
Flight schedules are fixed, and requests for schedule changes will not be accommodated.
All payments for Empty Leg Flights are due at the time of booking and are non-refundable except as per the cancellation policy.
12. Missed Flights
Customers must adhere to the Flight Itinerary provided by HYPE LUXURY. Failure to arrive at the aircraft prepared for departure at the scheduled time may result in a missed flight.
If a customer misses a flight, they are responsible for making alternate arrangements. HYPE LUXURY may assist in making alternate arrangements at an additional cost.
Customers will be charged for missed flights according to the terms and conditions of the confirmation.
13. Indemnification
Customers agree to defend, indemnify, and hold harmless Owner/Website and its affiliates from any claims, damages, costs, liabilities, and expenses arising from User Content, conduct, or violation of these Terms and Conditions.
14. Limitation of Liability
HYPE LUXURY, its officers, directors, agents, and affiliates are not liable for indirect, special, incidental, consequential, or punitive damages arising from the use of the site or services.
The company reserves the right to cancel or delay flights, alter routes, or change aircraft type without liability.
15. General Terms
- Termination: HYPE LUXURY may terminate access to the website at any time. Surviving provisions continue after termination.
- Force Majeure: HYPE LUXURY is not liable for acts beyond its control without any refund
- Access: Users are responsible for complying with applicable laws.

- Insurance: Operators are responsible for liability insurance.
- Modification of Services: HYPE LUXURY may modify or discontinue services.

1. Platform
HYPE LUXURY operates one or more websites, webpages, and mobile apps (referred to as the “Platform”) that constitute a marketplace for air charter services catering to users of such services (referred to as “Charterers”). The Platform may aggregate quotes for air charter services provided by third-party aircraft operators (referred to as “Operators”).
These Terms and Conditions regulate your access to and utilization of the Platform. As a Charterer, you agree to use the Platform strictly in accordance with these Terms and Conditions. Your access to and use of the Platform is solely for the purpose of making legitimate requests, facilitated by HYPE LUXURY, for services offered by the Operators (referred to as “Requests”).
HYPE LUXURY reserves the right to modify these Terms and Conditions at any time. Your continued use of the Platform signifies your acceptance of the Terms and Conditions in effect at the time of use.
2. HYPE LUXURY's Role
HYPE LUXURY functions as an air charter broker, acting as an intermediary between Operators and Charterers. Acting as an agent, HYPE LUXURY arranges air transportation by chartering aircraft from Operators on behalf of Charterers.
HYPE LUXURY does not operate, own, maintain, or charter aircraft, nor does it provide air transportation services directly. There exists no contractual agreement for air transportation between HYPE LUXURY and Charterers or passengers. HYPE LUXURY is not a party to the carriage or charter agreements between Operators and Charterers (represented by HYPE LUXURY), and bears no liability related to such agreements.
These Terms and Conditions do not constitute an air transportation contract, and no such contract will be formed between you and HYPE LUXURY.
3. Booking Process
The booking of air charter services (and related services) through HYPE LUXURY is subject to an Aircraft Charter Brokerage Contract to be executed between you and HYPE LUXURY.

You affirm that you possess the legal age and capacity to enter into binding agreements, including these Terms and Conditions, any Aircraft Charter Brokerage Contract, and any Carriage Agreement (between you, represented by HYPE LUXURY, and any Operator). You confirm that no restrictions prohibit you from entering into or fulfilling such agreements.
Your Requests must be genuine and not speculative, false, or fraudulent. You shall not make Requests or enter agreements on behalf of fictitious users, under false identities, with invalid payment methods, or by providing fraudulent information. Fraudulent actions will be subject to legal consequences as per applicable law.
You may not use the Platform to submit Requests or enter agreements on behalf of third parties unless legally authorized to do so.
You acknowledge that your use of the Platform is at your own risk and expense.
5. Termination of Access
HYPE LUXURY reserves the right to suspend your access to part or all of the Platform at its discretion, with or without prior notice and for any reason.
6. Ownership of Content
You acknowledge that all materials and information on the Platform, including data, software, images, videos, and written content (referred to as “Materials”), are the property of HYPE LUXURY or have been licensed to HYPE LUXURY. You may not use, reproduce, or distribute any Material without prior written consent from HYPE LUXURY. However, you may print and copy portions of the Platform, including these Terms and Conditions, for personal use in accordance with these Terms and Conditions.
7. Disclaimer and Limitation of Liability
All information provided on the Platform is for informational purposes only and without any warranty, whether express or implied. HYPE LUXURY bears no responsibility for the accuracy, reliability, or completeness of such information.
HYPE LUXURY and its affiliates shall not be liable for any damages, losses, or delays arising from your use of the Platform or any agreements entered into through it.
8. Indemnification
By using the Platform, you agree to indemnify HYPE LUXURY and its affiliates against any damages or liabilities resulting from your breach of these Terms and Conditions or any related agreements, or from actions performed on behalf of third parties.
9. Personal Data
Personal data processing by HYPE LUXURY is governed by the Privacy Policy available on the Platform.
10. Miscellaneous
These Terms and Conditions constitute the entire agreement between you and HYPE LUXURY regarding your use of the Platform, superseding any prior agreements. No variations to these Terms and Conditions shall be valid unless agreed upon in writing by HYPE LUXURY.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by German law, with disputes subject to the exclusive jurisdiction of the courts of Berlin, Germany.

These Terms & Conditions govern your access and use of the Platform. By using the Platform, you acknowledge and agree to comply fully with these terms. Your usage is limited to legitimate charter inquiries ("Requests") initiated through Hype Luxury Wings.
Hype Luxury Wings reserves the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the Platform signifies acceptance of any revised terms.
2. Scope of Services
Hype Luxury Wings functions solely as an air charter broker, facilitating bookings between Clients and Operators. It does not own, operate, or control any aircraft and is not itself an air carrier.
The company acts exclusively as an intermediary representing Clients in charter negotiations and bookings. No transportation agreement exists between Hype Luxury Wings and the Client; any flight services are governed by separate agreements between the Client and the Operator.
To comply with U.S. regulatory requirements under 14 CFR Part 295:
- Hype Luxury Wings is an agent acting on behalf of Clients;
- It is not an air carrier;
- All flights arranged through the Platform are operated by licensed direct air carriers.
3. Booking Process
Flight bookings facilitated through Hype Luxury Wings are governed by a Charter Brokerage Agreement between the Client and Hype Luxury Wings.
Information on the Platform does not constitute a binding offer. All proposals are indicative until confirmed in a formal agreement.
Hype Luxury Wings retains sole discretion to reject service requests without explanation.
4. Platform Usage
By using the Platform, you confirm that you:
- Are legally capable and authorized to enter into binding contracts;
- Will provide accurate and truthful information;
- Will not make speculative or fraudulent Requests;
- Will act on behalf of others only if lawfully authorized to do so.
You agree that your access to the Platform is at your own risk and cost.
5. Suspension or Termination of Access
Hype Luxury Wings reserves the right to suspend or terminate your access to all or part of the Platform at its sole discretion, with or without notice or justification.
6. Intellectual Property
All materials available through the Platform, including software, text, media, and branding, are the intellectual property of Hype Luxury Wings or its licensors.
You may only download or print content for legitimate use related to charter inquiries. Unauthorized use or duplication is prohibited.
7. Disclaimers and Liability Limitations
Information provided via the Platform is for reference purposes only and is not guaranteed to be accurate, current, or complete. Hype Luxury Wings disclaims any responsibility for:

These Terms are governed by the laws of the United Arab Emirates (UAE). Any disputes shall be resolved exclusively by the courts of Dubai. Hype Luxury Wings reserves the right to initiate legal proceedings in other jurisdictions if necessary.
