Terms and Conditions (UK)
CHAUFFEUR DRIVEN
All transactions between clients and Hype Luxury are governed by the terms and conditions set forth herein. By placing an order, the client acknowledges and agrees to these terms and conditions.
1. Purchase of Services
- By placing an order via the Website, phone, or email, the client affirms that they are legally competent to enter into binding contracts and are at least 18 years old.
- Hype Luxury, is an aggregator which accepts only direct booking requests for chauffeur-driven travel. Chauffeurs are not authorized to accept bookings directly. Clients must make reservations through the website, email, or phone.
- The contract for bookings is between Hype Luxury and the client (including agents, companies, passengers, or persons booking and paying for services).
- Hype Luxury only accepts direct client payments; chauffeurs do not handle payments.
- Hype Luxury reserves the right to cancel bookings, subject to availability, and will notify clients of cancellations via email, phone, or text.
2. Reservations
- The Hype Luxury reservation team operates 24/7 to assist clients. A 24-hour notice may be required to prepare vehicles. Prices are quoted in GBP, starting at the pickup point (A) and ending at the drop-off point (B), except for airport transfers or fixed-charge hires.
- To obtain a quote or book through agents, clients must provide full contact details, including name, contact number, and email address.
3. Online Bookings
- Online bookings are subject to Hype Luxury's approval. Errors in maps and quotes may occur, and Hype Luxury reserves the right to refund or cancel orders placed at incorrect prices. Prices and availability are subject to change without notice, and promotional products may be limited in quantity.
- Hype Luxury is not responsible for typographical errors and makes no warranty on the suitability of information and graphics on the site. A minimum 24-hour notice is required for online bookings; for bookings with less than 24 hours' notice, clients must call the reservation team.
- Online prices apply to UK travel only. Traveling to Europe requires calling the office. Bookings between 22:00 and 05:30, as well as during public and bank holidays, are subject to additional charges.
4. Privacy Policy
- Hype Luxury treats personal information as confidential and will not disclose it to third parties, using it only per the Privacy Policy. Booking requires personal details for identification and securing reservations. Payment information is securely encrypted by a third-party system. Email addresses are added to a mailing list, from which clients can unsubscribe. Hype Luxury reserves the right to use client company names or logos on websites without notice.
5. Single and Return Journeys
- Return or subsequent same-day journeys are subject to waiting time charges within 3 hours or outside London. Waiting time charges apply to sports events and concerts, and additional charges apply to single journeys to such events.
6. Waiting Time
- Airport pickups include 45 minutes of complimentary waiting time; private FBOs include 30 minutes. Other journeys include 15 minutes of complimentary waiting time. After complimentary waiting time, charges are applied in 15-minute increments to the provided debit or credit card.
7. Payments
- Charges are payable in advance unless the client has a credit account or pre-approved credit card. Additional charges, such as extra waiting time, will be charged to the provided card.
- Major debit and credit cards, including Amex, are accepted without extra charge. Card charges are non-refundable for booking cancellations.
- Prices include 20% VAT.
- Additional waiting time and car park charges may apply.
- Credit/debit card statements will show charges as Hype Luxury.
- Rates may change without prior notice.
- Stop charges: £25 + VAT per stop, with a 15-minute grace period allowed.
8. Cancellation and Refund Policy
- Cancellations or amendments must be acknowledged during office hours on the website. Wedding bookings require seven days' notice for cancellation. Fees apply for cancellations made within seven days or 48 hours of the booking date.
- Refunds are issued under specific terms, excluding non-refundable card charges. One-way journeys within London and airport transfers have a 12- or 24-hour free cancellation policy, respectively. Out-of-London bookings and event bookings have a 48-hour cancellation policy. Amendments made less than two hours before the scheduled time incur minimum fare charges.
- Prestige chauffeur vehicles have a 48-hour free cancellation policy. Cancellations within 48 hours are non-refundable.
- Multi-car or multi-day bookings have specific cancellation fees.
- No-show policy: Non-refundable if the client fails to show up.
9. Chauffeurs & Cars
- Chauffeurs drive at reasonable speeds considering road conditions and traffic. Routes are chosen based on convenience, not necessarily the shortest distance.
- Fleet categories include Luxury Saloon, Luxury MPV, Prestige SUV, and Prestige Saloon.
- Vehicles may be switched based on availability without prior notice.
- Sub-contracted vehicles may be provided.
- Clients must be fit to travel; intoxicated or disruptive passengers may be refused travel.
- Child seats: One provided free of charge; additional seats incur fees. Clients may use their own seats but are responsible for installation and removal.
- Animals: Only guide dogs and hearing dogs are allowed without prior agreement. Additional costs apply.
10. Responsibilities
- Hype Luxury is not responsible for luggage or property loss or damage unless due to negligence. Lost property will be returned at the client's expense.
- Missed flights: Hype Luxury is not responsible for missed flights.
- Damage to vehicles: Clients are responsible for repair costs if they damage the vehicle.
11. Account Services
- Clients must open an account with Hype Luxury and keep account details secure.
- Bookings must quote the account name or number.
- Bookings quoting the account number are authorized by the client, who is liable for all charges.
- Charges, fees, and VAT are payable within 30 days of invoice.
- Payments are made by bank transfer.
- Administration fees may apply to bookings or cancellations.
- Monthly invoices will be issued for account services.
- Late payments incur interest charges.
- Credit limits may be set for customers.
- Disputes must be submitted in writing within 14 days of receipt.
- All outstanding charges must be paid upon account termination.
12. General Exceptions
- Hype Luxury is not liable for failures or delays due to events beyond its control, such as natural disasters or traffic accidents. Efforts will be made to complete journeys with another chauffeur if possible.
- Obligations will be suspended during events beyond Hype Luxury's control.
13. Complaints
- Complaints should be addressed to the driver or company at the time of the issue. If unresolved, complaints must be submitted in writing within 14 days. Hype Luxury will acknowledge complaints within 14 days and respond within 28 days.
14. Zero Tolerance Policy
- Hype Luxury maintains a zero-tolerance policy against harassment, discrimination, and rudeness towards employees and contractors. Services will be withdrawn immediately in such cases, and payments will not be refunded.
15. Fraud
- Payments must be authorized by the cardholder. Hype Luxury reserves the right to cancel bookings if fraudulent activity is suspected, based on factors such as erroneous information, multiple payment attempts, or previous chargebacks. Suspected fraud will be reported to the appropriate authorities.
SELF DRIVE
1. Contract Formation
- By signing the rental agreement at the location where you rented the vehicle, you acknowledge and accept the terms and conditions herein.
2. Rental Period
- The vehicle is rented to you for the period specified in the agreement, not exceeding 30 days unless extended by mutual consent. Late returns are subject to additional charges at the daily rate specified at the rental location.
3. Obligations of the Renter
- Safeguard the vehicle and its keys.
- Lock the vehicle and use any security devices provided.
- Protect the vehicle from adverse weather.
- Use the correct type of fuel.
- Avoid damage from low-level objects.
- Not sell, rent, or dispose of the vehicle or its parts.
- Refrain from giving legal rights over the vehicle to others.
- Obtain our permission for any repairs, and provide receipts for reimbursement.
- Notify us of any faults immediately.
- Return the vehicle during business hours, ensuring a staff member inspects it. If returned outside business hours, you remain responsible for its condition until inspected.
You are liable for repair costs if:
- Extra costs are incurred to restore the vehicle to its pre-rental condition.
- There is damage to the vehicle's interior.
Ensure all personal belongings are removed before returning the vehicle.
4. Our Responsibilities
We maintain the vehicle to the manufacturer’s standards and ensure it is roadworthy and suitable for rental at the start of the rental period. We are liable for losses if:
- The vehicle does not match our description.
- The vehicle is not of expected quality.
- The vehicle is not fit to drive.
- We do not have the legal right to rent the vehicle.
We are responsible for injuries or fatalities resulting from our negligence and for foreseeable losses resulting from a breach of this agreement. We are not liable for indirect or unforeseeable losses.
5. Property Liability
- We are only liable for loss or damage to property left in the vehicle if it results from our negligence or breach of contract.
6. Vehicle Use Conditions
The vehicle must be driven only by you, any named drivers, or authorized persons. All drivers must have a valid driving license. Prohibited uses include:
- Hire or reward purposes.
- Illegal activities.
- Racing or testing the vehicle.
- Driving under the influence of alcohol or drugs.
- Driving outside the UK without written permission.
- Overloading the vehicle.
- Using the vehicle for purposes requiring an operator’s license without possessing one.
7. Towing
- Towing is prohibited unless expressly permitted in writing.
8. Charges
Charges are calculated based on our current price list and include:
- Rental and other specified charges.
- Costs for damages due to non-compliance with condition 3.
- Refueling service charges if fuel is not replaced.
- Fines, court costs, and administrative fees for traffic offenses.
- Costs of repairing unnoted damage.
- Loss-of-income charges if the vehicle is unavailable for rental.
- Customs and Excise charges, if applicable.
- Delivery and collection fees.
- Interest on overdue amounts.
- VAT and other applicable taxes.
You are responsible for all charges, even if another party has been designated to pay.
9. Insurance and Damage Protection
- Rides include third-party insurance and, if accepted, collision and loss damage waiver and theft waiver. Personal accident, belongings, and goods in transit insurance are also available if accepted. Detailed terms are available at the rental office of the provider. Hype is not directly responsible or going to interfere in any insurance, damage or claims.
10. Self-arranged Insurance
- You may arrange your own insurance with our approval. Proof of valid insurance must be provided. Any changes to the policy must be approved by us. You are responsible for all claims and costs if your insurance fails.
11. Accident Protocol
In the event of an accident:
- Do not admit responsibility.
- Obtain names and addresses of all involved parties and witnesses.
- Secure the vehicle.
- Notify the police if injuries occur or if responsibility is disputed.
- Contact us immediately.
- Complete and submit an accident report form.
The vehicles may be equipped with telematic devices for tracking purposes.
12. Data Protection
- You consent to us using your information for market research and, in the event of a breach of this agreement, sharing it with credit reference agencies, debt collectors, and other relevant organizations.
13. Termination of Agreement
- We may terminate the agreement immediately if you become insolvent or breach its main terms. Termination does not affect our right to recover owed amounts or claim reasonable costs. We may repossess the vehicle without undue force.
14. Governing Law
- This agreement is governed by the laws of the country in which it is signed. Disputes will be settled in the courts of that country.
